Terms and Conditions of Sale and Service

1. Definitions
For the purposes of these Terms and Conditions of Sale and Service:

“Powercut”, “Powerpools” and “Jacuzzi West Wales” are trading names of Powercut (Wales) Ltd., registered at Oaklands Mansion, Cwmffrwd, Carmarthen.

“We”, “us”, “our” refer to Powercut (Wales) Ltd., its owners, employees and associates.

“You”, “your” refer to the individual or business purchasing goods under these terms.

“Manufacturer” refers to the manufacturer, importer or UK distributor of any product supplied.

2. Our Commitment to You
We aim to provide a high-quality service and ensure customer satisfaction in all dealings with us. By purchasing goods from us, you confirm that you have read, understood and agree to be bound by these Terms and Conditions.

3. Product Suitability and Recommendations
Any recommendations we make regarding the suitability or use of products are based solely on the information you provide. It is your responsibility to ensure that this information is complete and accurate.

We are happy to assist you during your decision-making process. Some products may carry specific usage recommendations or restrictions which must be observed. We strongly recommend that you also consult the manufacturer directly for further guidance.

We can help explain manufacturer recommendations as set out in the operator’s manual. However, unless you have specifically informed us of an intended use prior to purchase, you accept full responsibility and liability for any consequences arising from the use of the product.

4. Ordering
By placing an order, you agree to these general Terms and Conditions and any additional item-specific terms that we may notify you of.

You are responsible for ensuring that the correct items and quantities are ordered. For items not held in stock, a non-refundable deposit is required at the time of order. This will be a minimum of £1000 on hot tub orders, or such other amount as advised at the time, plus any additional costs incurred. If you cancel the order, the deposit will not be refunded.
​
If ordering using manufacturer part numbers, you must have access to the relevant parts lists. We may be able to supply these by prior arrangement. Returns will not normally be accepted where incorrect items were ordered but supplied correctly.
All goods must be checked upon delivery. Any issues, including damage, must be reported to us within 24 hours. For assistance, please contact us immediately on 01267 235625.

5. Invoices, Payment, Title and Risk
Any query or dispute relating to an invoice must be raised within 14 days of the invoice date. After this period, the invoice will be deemed accepted in full.

Payment is due on request. Unless agreed otherwise in writing, all goods must be paid for in full before leaving our premises.
​
Legal title to all goods remains with Powercut (Wales) Ltd. until payment has been received in full. You agree to allow us unrestricted access to recover goods where payment terms have not been met.
​
Risk in the goods passes to you upon receipt or delivery.
​
6. Safety
Hot tubs and chemicals can be hazardous. You agree not to use, or allow others to use, any equipment supplied by us unless you are confident in its safe operation.

All new hot tubs are supplied with an operator’s manual detailing safe use. You agree to follow all safety instructions and guidelines. It is a condition of sale that you do not operate, or allow operation of, any hot tub until you are fully familiar with its operation.
​
You are responsible for ensuring that all goods are used only by suitable persons, in safe conditions, and with due care to protect yourself and others.
​
7. Delivery
While all orders are treated as urgent, delivery dates and times cannot be guaranteed. Estimated delivery arrangements are normally discussed at the time of sale.

For whole goods, transportation to a specific location is arranged separately following receipt of your order and payment.
​
For consumer sales, the handover or delivery point for all goods sold by Powercut or Powerpools is the public entrance to Oaklands Mansion, Cwmffrwd, Carmarthen SA31 2ND (the “primary delivery point”) or The Powerpools Showroom, Pensarn, Carmarthen SA31 2BS. Any returns will be collected free of charge from either of these locations (see our Returns Policy for details).

Additional transportation or bespoke services are not included unless specifically agreed. All orders are subject to availability. We accept no liability for costs arising from delayed, postponed or cancelled deliveries where causes are beyond our control.

Delivery and installation services including Kerbside deliveries are available for addresses located within a 65-mile radius of the Powerpools address. Any addresses beyond this point will be charged an additional fee, unless agreed first by Powercut, Powerpools or Jacuzzi West Wales.
​
Standard Kerbside hot tub delivery is provided on a kerbside basis. This means the hot tub will be delivered to the nearest safe and accessible point at the delivery address, typically the roadside or driveway entrance. Kerbside delivery does not include moving the hot tub beyond this point, positioning it in its final location, or installing it. It is the customer’s responsibility to ensure suitable access is available and to arrange any additional handling required beyond the kerbside.
Delivery and installation service includes transportation of the hot tub to the property, placement into its intended position (subject to suitable access), and installation in accordance with manufacturer guidelines. Any site-specific requirements, access restrictions, ground preparation, electrical connections, or lifting equipment must be discussed and agreed in advance. Additional charges may apply where access is restricted, specialist equipment is required (i.e. crane or hi-ab), or conditions differ from those described at the time of order.

8. Warranty
All new products are supplied with the manufacturer’s warranty. Warranty terms and durations vary by brand and model. Details are available on request.

Proof of purchase is required for any warranty claim.
​
For warranty repairs, you must allow us reasonable access to the goods for inspection and repair. All claims must comply with the relevant manufacturer’s warranty terms.

9. Returns
Our Returns Policy is displayed at our premises and is available on request.
​
10. Privacy
We require certain personal information to process orders and manage our relationship with you. This information may be shared with couriers, manufacturers or suppliers for delivery, warranty registration or related purposes. This may result in contact from those parties, including for marketing purposes.
​
We store all personal data securely and in accordance with the Data Protection Act 1998. You have the right to request correction of your data at any time. We do not sell or trade your personal information to third parties.
​
11. General
Prices may be revised at any time without notice. All orders are subject to availability. We reserve the right to refuse to supply any individual, company or organisation at our discretion.

12. Governing Law
These Terms and Conditions are governed by the laws of England and Wales. Any legal proceedings shall be brought in the court nearest to Carmarthen.
